10.32.010 Interfering with superintendent of parks department.
No person shall prevent, delay or interfere with the superintendent of the parks department or his employees, in the planting, pruning, spraying or removing of a tree on the public highway, park, parking strip or other public place, or in the removal of stone, cement or other substance about the trunk of a tree. (Ord. 2122 § 1, 1983).
10.32.020 Placing obstacles in park.
It shall be unlawful for any person to place any obstacle whatsoever in any park or playground in the city except by the permission in writing of the park superintendent or the city manager. (Ord. 2122 § 1, 1983).
10.32.030 Animals grazing prohibited.
It shall be unlawful for any person to permit any horse, cow, sheep or other livestock in his possession or under his control to graze within the area of any park or playground in the city without permission in writing of the park superintendent or the city manager. (Ord. 2122 § 1, 1983).
10.32.040 Area permitted for horseback riding.
Repealed by Ord. 2694. (Ord. 2122 § 1, 1983).
10.32.050 Driving or parking vehicles confined to street – Exceptions.
It shall be a Class III civil infraction for any person to drive or park any automobile or other vehicle within the area of any park or public playground in the city, except on areas clearly designated or dedicated as motor vehicle areas. Driving of motor vehicles within such area or areas shall be limited to that necessary for parking purposes; provided, however, that during city-wide celebrations occurring at Lake Sacajawea Park, written permits may be issued authorizing vehicles and trailers to be driven or parked in areas of such park that are specifically designated as vehicle areas for the duration of such city-wide celebration. The operation or parking of a vehicle that is not in strict conformity with any such written permit shall be a Class III civil infraction, and any vehicle parked without such written permit or in excess of the time limits specified therein or contrary to the provisions of such written permit shall be subject to impoundment as provided in LMC 11.16.030(3). 10.32.060 Picking flowers, injuring shrubs, etc., prohibited.
It shall be unlawful for any person to pick any flowers or pick or break any shrubs or trees, or any branches or limbs thereof, within the area of any public park or playground in the city, except upon express permission in writing of the park superintendent or the city manager. (Ord. 2122 § 1, 1983).
10.32.070 Luring water fowl.
It shall be unlawful for any person to lure, coax or entice by means of scattering feed, or otherwise, any of the water fowl which habitually roost on or use the water of Lake Sacajawea to leave the area of the park immediately adjacent to the lake; and it shall be unlawful for any person to lure, coax or entice any such water fowl to come within 50 feet of any paved public highway. 10.32.080 Trees and shrubbery – Cutting, removing, injuring, placing posters and fixtures thereon.
No person shall, without a written permit of the superintendent of the park department or city manager, cut, prune, rake, climb, injure or remove any living tree in any public highway, park, parking
strip or other public place in the city, or cut, disturb, or interfere in any way with the roots of any tree on a public highway, park, parking strip or other public place therein; or spray with any chemicals or insecticides any tree in any public highway, park, parking strip or other public place therein; or place any rope, sign, poster or other fixture on a tree or guard in a public highway, park, parking strip or other public place therein, or injure, misuse or remove any device placed to protect such tree on a public highway, park, parking strip or other public place therein. 10.32.090 Permit for planting trees or shrubs.
No shade or ornamental tree or shrub shall be planted in any of the public highways, parks, parking strips or other public places in the city until such tree or shrub shall have first been approved and the place where it is to be planted designated by the superintendent of the park department and a permit granted therefor. (Ord. 2122 § 1, 1983).
10.32.100 Hitching animals to trees in public places prohibited.
No person shall fasten a horse or other animal to a tree in the public highway, park, parking strip or other public place in the city, or cause a horse other animal to stand so that the horse or animal could injure such tree. (Ord. 2122 § 1, 1983).
10.32.110 Obstructing roots of trees.
No person shall, without the written permit of the superintendent of the park department place or hereafter maintain upon the ground in the public highway, park, parking strip or other public place in the city, stone, cement or other substance which shall impede the free passage of water and air to the roots of any tree in such highway, park, parking strip or other public place, without leaving an open space of ground outside of the trunk of such tree in area not less than four square feet. (Ord. 2122 § 1, 1983).
10.32.120 Guarding trees in public place near building construction.
In the erection or repair of any building or structure the owner thereof shall place such guards around all nearby trees on the public highway, park, parking strip or other public place as shall effectively prevent injury to them. (Ord. 2122 § 1, 1983).
10.32.130 Pouring injurious liquid near trees.
No person shall pour salt water or other injurious liquid upon any public highway, park, parking strip or other public place in such a way as to injure any tree planted or growing thereon. (Ord. 2122 § 1, 1983).
10.32.140 Attaching electric wires or wireholders to trees.
No person shall, without the written permit of the superintendent of the park department, attach any electric wire, insulator, or any device for the holding of an electric wire to any tree growing or planted upon any public highway, parking strip or other public place of the city. (Ord. 2122 § 1, 1983).
10.32.150 Electric wires through trees, parks, etc. not to contact trees.
Every person having wires charged with electricity running through a public highway, park, parking strip or other public place shall securely fasten such wires so that they shall not come in contact with any tree therein. (Ord. 2122 § 1, 1983).
10.32.160 Removal of electric wires or power while removing or pruning trees – Notice.
Every person having wires charged with electricity running through a public highway, park, parking strip or other public place shall temporarily remove any such wires or the electricity therefrom when it shall be necessary, in order to take down or prune any tree growing in said public highway, park, parking strip or other public place, within 24 hours after the service upon the owner of the wires, or his agent, of a written notice to remove the wires, or the electricity therefrom, signed by the superintendent of the park department or the city manager.
