19.16.010 Purpose and nature.
The purpose of this chapter is to establish regulations to preserve and protect residential areas from the adverse impacts of activities associated with home occupations; to provide residents of the community the opportunity to use their homes as a place of livelihood for the production and/or supplementing of personal and family income; and to establish criteria and development standards for home occupations conducted in dwelling units in residential districts. 19.16.020 Home occupation defined.
The term “home occupation” is defined for the purpose of this chapter and for the purpose of LMC Title 19, as an accessory use of a dwelling for an office or place of business so long as such dwelling maintains the residential character of the area and the office or place of business contained within such dwelling does not generate more vehicular or pedestrian traffic than is normal for a dwelling in the neighborhood and zoning district in which it is located. A dwelling in which there is located an office or place of business shall not give the appearance of a commercial enterprise. All home occupations shall meet the standards set forth in this chapter, and elsewhere in this title. (Ord. 2207 § 1, 1984).
19.16.030 Requirements.
Home occupations shall not be permitted without a business license having first been issued in accordance with LMC Title 5. All home occupations shall comply with all applicable ordinances of the city, and shall be consistent with the following provisions:
(1) Home occupations are restricted to not more than 30 percent of the usable floor area of the dwelling in which they are located. The principal use of the dwelling must remain residential.
(2) No detached accessory buildings may be used for home occupations.
(3) Only persons residing in the dwelling may be engaged in the home occupation.
(4) The conduct of any home occupation, including, but not limited to the storage of goods and equipment, shall not reduce or render unusable required off-street parking.
(5) No goods or merchandise shall be displayed or sold on the premises.
(6) Home occupations shall not be permitted where the same shall require external alteration of a dwelling or involve construction features not customarily found in a dwelling.
(7) No stock in trade or merchandise is to be kept on the premises other than inventory and incidental supplies which are necessary for the conduct of the home occupation.
(8) No noise, dust, odors, noxious fumes or vibrations resulting from a home occupation shall exceed that which is normally produced in a single-family dwelling. Mechanical or electronic equipment incidental to the conduct of a home occupation may be used provided such use does not create visible or audible interference in radio, television or telecommunication receivers or transmitters, or cause fluctuations in line voltage off the premises. Home occupations shall not interfere with the delivery of utilities or other services to the area
(9) One sign is permitted to advertise the home occupation, however, such sign shall be no larger than one square foot in area, nonilluminated, and must be attached to the dwelling. (Ord. 2207 § 1, 1984).
